ANNEX F - CHAPTER 11
EMPLOYER'S LEGAL LIABILITY
COVERAGE
-
Coverage under this section is applicable in Canada and to commanders at overseas locations where coverage under the Government Employee's Compensation Act (GECA), or similar law is not available.

Coverage shall be legal liability for bodily injury or death to NPF paid civilians or part-time service employees resulting from accidents during the course of their NPF employment.

In addition to thus protecting the unit commander against such claims, the following voluntary benefits are provided irrespective of any legal liability:

Two-thirds of NPF lost time earnings up to a maximum of $140 per week. Such benefits to commence on the 8th day unless the lost time exceeds six weeks in which case benefits are payable from the first day;

medical, hospital and surgical expenses for the period within 26 weeks of the accident to a maximum of $1,000; and
-
a scale of benefits payable in the event of partial or permanent disability.
LIMIT OF LIABILITY

The limit of liability coverage under this section is $1,000,000 for any single occurrence. The unit deductible for a single occurrence is as outlined in paragraph 15 of this chapter.
PREMIUM
-
The premium for this coverage is paid by the CFCF.

Coverage for Employer's Legal Liability is obtainable as follows:
-
all Canadian employees are normally covered under the Government Employees Compensation Act. If not, they are insured under this section;
-
non-Canadian employees are covered under specific insurance programmes or covered under this section; and
-
effective 1 January 1970 coverage for German employees of NPF agencies for accident insurance are as prescribed in "Agreement on reimbursement of the Federal Republic of Germany for payments arising out of obligations towards local national employees of the Canadian Forces with regard to accident insurance."

By this agreement a German National employed by a Canadian NPF operation who is injured while so employed may be granted a one-time payment or an annual allotment as decided by German government authorities. Payment of such awards is the responsibility of the employing NPF entity. See Annex J.
